Your privacy is important to us. It is Rockville Nursing Home Foundation, Inc.'s policy to respect your privacy and comply with any applicable law and regulation regarding any personal information we may collect about you, including via our website, https://www.rnhfoundation.org.

By clicking the “I Agree” and “Submit” buttons on the application or Contact Us pages of our website you are agreeing to this Privacy Policy. Our mission is to provide scholarships to deserving students in the nursing and allied health sciences. As needed to make decisions regarding the rewarding of scholarships, we will collect information about you, some of which is considered “Personally Identifiable Information”. With the possible exceptions found in the Collection and Use of Information section of this Privacy Policy, we will NEVER share your information with third parties unless ordered or required to do so by a court or other government or law enforcement agency. If permitted, we will attempt to contact you if your personal information has been shared to tell you what information was shared and to whom it was disclosed. HOWEVER, while will NEVER share your information (except as required [see above]), we can use your information for purposes of analysis and share and publish the results of any analyses (after your personally-identifiable information has been sanitized (i.e., removed) and aggregated with other applicants and scholarship recipients) in public, commercial, and private forums as we see fit for fundraising and other endeavors with the goal of broadening our ability to provide scholarships to a growing, diverse body of deserving people. We do NOT use cookies, pixels, nor any other means to track you, but we can’t control whether other websites track you. We have several providers we use to collect and store your information and to communicate via email; their information, including links to their respective privacy policies, can be found below. At any time, you can use the link below to email us with a request to stop contacting you and/or remove the sensitive elements of the information we have for you, including information which might be stored by one of our providers, and also to request that we not contact you again, but you understand that doing so while you are an applicant or scholarship recipient might negatively impact our ability to continue processing your application and/or your ability to receive scholarship funds from us.

Information We Collect

To allow us to evaluate your application for initial and continued receipt of scholarship funds, we will collect both generic information about you as well as “Personally Identifiable Information” (“PII”). PII is any information which could be reasonably used to identify you or your household. This includes information about you (such as your name, physical address, social security number, date of birth, driver’s license number, phone number, and email address).

PII falls into one of two categories: “voluntarily provided” PII and “automatically collected” PII.

“Voluntarily provided” PII refers to any information you knowingly and actively provide us when applying for and/or receiving scholarship funds from us. “Voluntarily provided” PII might also refer to information found in, or obtained from, the document(s) you upload or otherwise send to us.

“Automatically collected” PII refers to any information automatically collected using cookies or other tracking technologies, as well as information sent by your devices in the course of accessing our website. (NOTE: This is a standard disclaimer. As stated above, we do NOT log or use any type of cookies or pixels or any other technology to track you or your activity, whether on our site or elsewhere online.) We do NOT require, accept, or process payments of any kind, nor we will ever ask you for any bank account, credit card, or other financial information.

Unless more specifically defined, the term “information” as used in this document will refer to all type of information we have about you, both non-PII and PII.

Our Privacy Policy does not apply after you leave our site. In the event our site contains links to third-party sites or services, please be aware that those sites and services have their own privacy policies. After following a link to any third-party content, you should read their posted privacy policy information about how they collect and use personal information.

We collect the following information from you:

11.  Ethnicity (you have no obligation to declare your ethnicity and your application WILL NOT be adversely affected if you choose not to declare)

12.  Level of education and/or relevant work experience

13.  Desired level of schooling you wish to pursue with your Scholarship

Legitimate Reasons for Obtaining Your Information

We collect your information for purposes of evaluating your initial application, to assess your ability to continue receiving scholarship monies from us, for communication and follow up with you from time to time, and for statistical analyses (see below regarding removal of PII during such analyses).

We will not collect information from you without first obtaining your consent.

Collection and Use of Information

We may collect information from you when you do the following:

·       Submit an application and supporting documents for initial and continued scholarship; and,

·       Contact us via email or similar technologies.

We may collect, hold, use, and disclose information for the following purposes:

·       to evaluate your application;

·       to contact and communicate with you;

·       for internal record keeping and administrative purposes;

·       for statistical analyses (see below regarding removal of PII during such analyses); and,

·       to comply with our legal obligations, retain any right(s) we might have, and resolve any disputes between you and us.

Excepting the individuals and entities identified in next section (“Disclosure of Personally Identifiable Information”), except as required by law, we will never disclose or share the following information with any other organization:

·       Your name;

·       Your social security number;

·       Your date of birth (though we can and will use your age as calculated from your date of birth);

·       Your contact information (physical address, phone number[s], email address[es]);

·       Your employer name(s) (past or present); and,

·       PII found in any document you gave us, whether it’s your PII or the PII of others (e.g., tax returns which include you and other person[s]).

Disclosure of Personally Identifiable Information

Except for information we collect for the sole purpose of SMS opt-in, including phone numbers,we may disclose your PII and other information to:

·       our employees and members of the Board of Governors’ Scholarship Review Committee;

·       a parent, subsidiary, successor, or affiliate of our company, (none currently exist - should they be created in the future, we will notify you in writing regarding an updated Privacy Policy);

·       a successor entity which buys or to which we transfer all or substantially all of our assets and scholarship-making processes, to ensure continuity of scholarship operations;

·       third-party service providers for the purpose of enabling them to provide their services, including (without limitation) IT service providers (including service[s] we use to collect and store your information, such as data storage, hosting, communication, and server providers), error loggers or problem-solving providers, and professional advisors with whom we have a written Non-disclosure/Confidentiality Agreement or such other agreement which protects your information);

·       courts, tribunals, governmental or other regulatory authorities, and law enforcement officers, as required by law, in connection with any actual or prospective legal proceedings, or in order to establish, exercise, or defend our legal rights; and,

·       employees and agents of the education institution(s) (i.e., colleges and universities) for whom you give us permission to disclose your PII, as needed to facilitate the timely, accurate transmission and proper crediting of scholarship funds to your account with said institution(s).

Third parties we currently use include:

·       Web hosting and application data storage via Squarespace.com

·       Email hosting via godaddy.com

·       Document upload and storage via dropbox.com

Use of Your Information for Analysis

You understand and agree that after your PII has been removed and aggregated with other applicants and scholarship recipients, we may use your information for purposes of analysis, including sharing and publishing the results of any analyses in public, commercial, and private forums to enhance our visibility and help grow our ability to fund scholarships.

Security of Your Personal Information

When we collect and process any of your information, and for as long as we retain your information, we will protect it within commercially acceptable means to prevent loss and theft, as well as unauthorized access, disclosure, copying, use, or modification.

Although we will do our best to protect the personal information you provide to us, we advise that no method of electronic transmission or storage is 100% secure, and no one can guarantee absolute data security.

Our website is hosted by Squarespace. Squarespace provides us with the platform that allows us to have an online presence and to make the application and process conveniently available to you. Information you enter via the website and/or its application may be stored through Squarespace’s data storage, databases, and the general Squarespace.com applications. We use Dropbox for document upload and for online document storage. The Privacy policy for Dropbox can be found here.

We use RingCentral for our phone and SMS services. It is important to note that even if you consent to the sharing of your information, this practice is strictly prohibited according the RingCentral SMS/MMS content policies. We use GoDaddy for our email hosting. The Privacy Policy for GoDaddy can be found here.

We use Microsoft for our email, document, and spreadsheet enterprise applications. The Privacy Policy for Microsoft can be found here.

The credentials for all of the services we use are protected by robust passwords which are changed at regular intervals, and are further secured via multi-factor authentication.

We use physical security measures and maintain current subscriptions for other commercially available, software-based endpoint protection products to help further ensure the privacy and security of your information and to protect our physical and electronic assets.

How Long We Keep Your Information

Subject to the protections and permitted usages identified elsewhere in this document, we can keep and use your information for as long as we want. At any time you may email us at privacy@rnhfoundation.com and request that we permanently delete your PII, including any document(s) which might contain PII, from the platforms and services we use to store our data, but we can and will retain your non-PII for statistical analyses and compliance. If you have provided us with PII such as an email address when contacting us, you understand and agree that we may retain your information during our active relationship with you (i.e., as long as you are applying for or receiving scholarship funds from us). You understand and agree that we will also maintain your information after you are no longer an active scholarship recipient, as needed to both document compliance and to help us continue developing a legacy of helping deserving students pursue their careers in the fields of nursing and the allied health sciences. If in our discretion your personal information is no longer required for these purposes, we will delete it or make it anonymous by removing all details that identify you.

However, if necessary, we may also retain your information for our compliance with a legal, accounting, or reporting obligation or for archiving purposes in the public interest, scientific, or historical research purposes or statistical purposes.

Children’s Privacy

Nothing we do is directed at children under the age of 13, and we do not knowingly collect personal information about children under 13. The sole exception to this policy might be in instances where, in order to document your income for purposes of assessing your application for scholarship, tax return(s) you provided us might also list other dependents under the age of 13. Regardless, we do not collect information about any individual other than the applicant.

International Transfers of Information

To the best of our efforts and knowledge, the personal information we collect is stored and/or processed in the United States, or where our service or third-party providers maintain facilities.

If we gain knowledge that your information is stored or processed in other countries we will notify you in writing and take all reasonable precautions to protect your information in accordance with this privacy policy.

Your Rights and Controlling Your Information

Your choice: By providing personal information to us, you understand we will collect, hold, use, and disclose your personal information in accordance with this Privacy Policy. You do not have to provide personal information to us, however, if you do not, it might adversely affect our ability to evaluate your scholarship application and/or provide you with scholarship funds.

Information from third parties: If we receive personal information about you from a third party, we will protect it as set out in this Privacy Policy. If you are a third party providing personal information about somebody else, you represent and warrant that you have such person’s consent to provide the personal information to us.

Marketing permission: By clicking the “Submit” button on the application page of our website you agree that we can use information you provide to us to contact you for purposes of informing you about the status of your application or scholarship, and to contact you to inform you about other opportunities we think might benefit your pursuit of knowledge and experience. You may change your mind and revoke this consent at any time by contacting us using the contact information located at the bottom of this document.

Access: You may request details of the personal information that we hold about you.

Correction: If you believe that any information we hold about you is inaccurate, out of date, incomplete, irrelevant, or misleading, please contact us using the details provided at the bottom of this document. We will take reasonable steps to correct any information found to be inaccurate, incomplete, misleading, or out of date.

Non-discrimination: Except as it relates to us being able to properly evaluate your application for both initial and continued scholarship, we will not discriminate against you in any way for exercising any of your rights over your information.

Notification of data breaches: We will comply with laws applicable to us in respect of any data breach.

Complaints: If you believe that we have breached a relevant data protection law and wish to make a complaint, please contact us using the details below and provide us with full details of the alleged breach. We will promptly investigate your complaint and respond to you, in writing, setting out the outcome of our investigation and the steps we will take to deal with your complaint. You also have the right to contact a regulatory body or data protection authority in relation to your complaint.

Unsubscribe: To unsubscribe or opt-out of communications, please contact us using the contact information located at the bottom of this document We may need to request specific information from you to help us confirm your identity.

Business Transfers

If we or our assets are acquired, or in the unlikely event that we go out of business or enter bankruptcy, we would include data, including your information, among the assets transferred to any parties who acquire us. You acknowledge that such transfers may occur, and that any parties who acquire us may, to the extent permitted by applicable law, continue to use your information according to this policy, which they will be required to assume as it is the basis for any ownership or use rights we have over such information.

Our website may link to external sites that are not operated by us. Please be aware that we have no control over the content and policies of those sites and cannot accept responsibility or liability for their respective privacy practices.

Changes to This Policy

At our discretion, we may change our privacy policy to reflect updates to our business processes, current acceptable practices, or legislative or regulatory changes. If we decide to change this privacy policy, we will post the changes here at the same link by which you are accessing this privacy policy.

If required by law, we will get your permission or give you the opportunity to opt in to or opt out of, as applicable, any new uses of your information.

Additional Disclosures for California Compliance (this section applies to California residents only)

Under California Civil Code Section 1798.83, if you live in California and your business relationship with us is mainly for personal, family, or household purposes, you may ask us about the information we release to other organizations for their marketing purposes.

We will email you a list of categories of PII we revealed to other organizations for their marketing purposes in the last calendar year, along with their names and addresses. We adhere to the standards outlined in this privacy policy, ensuring we collect and process PII lawfully, fairly, transparently, and with legitimate, legal reasons for doing so.

California Notice of Collection

In the past 12 months, we have collected the following categories of PII enumerated in the California Consumer Privacy Act:

·       Demographics, such as your age or gender. This category includes data that may qualify as protected classifications under other California or federal laws.

·       Audio or visual data, such as photos or videos you share with us or post on the service.

·       Employment and education data, such as data you provide when you apply for a scholarship with us.
